Terms of use

These are the rules for using Cartunda. Using the site means agreeing to them.

What this site is

Cartunda helps a group of people buy things together from one shop. One person — the organiser — collects what everybody wants, places a single order with the shop, and collects the money. The site works out who owes what, splitting shipping and charges across the order, and keeps track of who has paid.

What it is not

It is not a shop, and it never handles money. Nothing is sold here. No payment passes through this site: the organiser publishes how they want to be paid, you pay them directly by whatever means you both use, and they mark it received by hand. There is no escrow, no card processing, and no refund mechanism, because there is nothing here to refund from.

It is not a party to your purchase. The agreement to buy is between the organiser and the shop, and the arrangement to chip in is between you and the organiser. If an order arrives late, arrives broken, or does not arrive, that is between you, the organiser and the shop.

Your account

• Use a real, working email address. It is how everything reaches you, including requests for money.
• Keep your password to yourself. Anything done from your account is treated as done by you.
• One person, one account. Do not sign up on somebody else's behalf.
• You must be old enough to enter a contract where you live.

If you join a purchase

• Add items honestly — the right link, the right price, the quantity you actually want. The organiser is buying from what you wrote.
• Pay what you owe, promptly. The organiser has usually already paid the shop from their own pocket, so a late payment is money out of theirs.
• Nobody here can force a payment, and the site cannot recover one. This runs on people keeping their word.

If you organise one

• Publish payment details that are actually yours and actually work.
• Order what people asked for, and say so honestly when something is unavailable, cancelled or delayed. The item statuses exist for this.
• Enter the real shipping cost once you know it, so the split is right.
• Charge fairly. You may add a service fee for your trouble where the site offers it; you may not quietly inflate prices or shipping.
• Money you collect for a purchase is for that purchase.
• Do not misuse what you see. Members' names, addresses and orders are shown to you so you can run the purchase, and for nothing else.

If you run a subscription list

• Send it to people who asked. Everybody on your list confirmed by email, and you must not add anyone by another route.
• Do not use it for anything other than telling people about purchases you have opened.
• The unsubscribe link works instantly and cannot be turned off.

What you may not do here

• Organise the purchase of anything illegal where you or the members are, or anything that requires a licence you do not hold.
• Impersonate anybody, or use the site to collect money you do not intend to spend as described.
• Send spam, harass other members, or scrape the site.
• Attack the service — break into accounts, probe for holes, or overload it. Responsible reports of genuine problems are welcome instead.

Content you enter

What you write — purchase descriptions, item notes, your subscription blurb — stays yours. You give Cartunda permission to store and display it as the site needs to in order to work, and you confirm you are entitled to post it. Public listings are reviewed before they appear, and anything may be removed if it breaks these rules.

Suspension

An account may be suspended or removed for breaking these terms, particularly for taking money and not delivering. Where it is reasonable to explain first, it will be explained first.

Availability

The site is provided as it is, with no promise that it will be available, uninterrupted, or free of faults. Keep your own record of anything you cannot afford to lose. Backups are made in good faith but are not a guarantee.

Liability

To the extent the law allows, whoever runs this site is not liable for anything you lose through using it — including money you paid an organiser, goods that never arrived, or a purchase that fell apart. Those are between you and the other people involved.

Nothing here limits liability that cannot lawfully be limited — including for death or personal injury caused by negligence, for fraud, or for rights you have as a consumer that a contract cannot remove.

Your data

What is collected and what you can do about it is set out on the privacy page, which forms part of these terms.

Changes

These terms can change. When the wording changes, the date at the top changes with it, and you will be asked to accept the new version the next time you sign in. Carrying on using the site after that means you accepted it.

Ending it

You can delete your account at any time from your account page, subject to settling anything you owe and finishing anything you are organising. What survives deletion, and why, is explained on the privacy page.

Governing law

These terms are governed by the law of Lithuania, and its courts have jurisdiction over any dispute — without taking away any protection you have under the law of the country you live in.

Who is responsible

Cartunda is run by Dovydas Rimeisis, who decides what is collected here and why — in data protection language, the controller.
